Body Shop Health Club, Inc.("The Body Shop Health Club", “we”, “us”, “our”) has created these Club Rules, Regulations & Policies ("Rules", "Policy") in order to demonstrate our commitment to cultivate a safe and enjoyable environment for our customers, members, and guests (“you”, “yours” or “user”). We believe these rules constitute the best solution to the many complex issues and concerns associated with the operation of our club ("facility", "services").
The obligation to enforce these rules lies primarily in the hands of The Body Shop Health Club management and its employees. It is our responsibility to assure members and guests of all of the courtesies, comforts and services that we provide. It is also the duty of our members and guests to know our club rules and to cooperate with the enforcement of these rules at all times.
The Body Shop Health Club may, in its sole discretion, modify or amend these rules & policies at any time without notice. All approved signs posted within the facility shall be considered a part of the Policy of The Body Shop Health Club.
Violation of the rules of our club may result in a reprimand, suspension or expulsion. The Club small have the unqualified right to make such rules as it deems necessary or appropriate. The rules shall be available to all members upon request.
ANIMALS
Animals (except for service dogs) are not permitted in the Club.
APPLICATION FOR MEMBERSHIP
Each applicant for membership in the Club shall complete a Membership Application providing correct information in a format prescribed by TBSHC together with the applicable fees.
• Nature of Membership. Memberships are mere licenses which shall, depending on membership type, permit the member(s) thereof the right to use the facilities of TBSHC. Membership does not confer any proprietary right of interest to any properties, assets, facilities, premises, or other things whatsoever leased or owned by TBSHC. Nor does membership privilege confer right of the members to participate in the management of TBSHC in any way or any of the debts or obligations of TBSHC. Except as otherwise herein provided, TBSHC is not obligated to repurchase a license or to secure a transfer of membership title or interest in the club or its assets.
• Value of Membership. Membership is non-transferable, may not be used as barter or trade, and has no value other than for members. However, TBSHC may transfer the membership to any other entity at its sole discretion provided there is no material change in facilities or services.
BICYCLES, SCOOTERS & SKATEBOARDS
Bicycles are not permitted inside the Club. Scooters may be permitted if they are compactable and fit inside the lockers located within the facility. Skateboards may also be permitted if they fit in lockers located within the facility. No skateboards are scooters are permitted on the gym floor. TBSHC is not liable for stolen bicycles, scooters or skateboards.
CARDIOVASCULAR AREA RULES
• Stop exercising if you experience dizziness, pain, or unusual discomfort.
• Accelerated weight loss clothing is not permitted.
• Proper workout attire required (no jeans, open toe shoes, boots).
• No food or drink, except bottled water and performance beverages. No glass containers.
• TBSHC reserves the right to ask members to discontinue the use of cardiovascular equipment if it is believed that time on equipment is excessive or poses a possible risk to its members.
CARDIOVASCULAR AREA ETIQUETTE
• Please wipe down equipment after use. Spray disinfectant on towel only; do not spray directly on equipment.
• Please refrain from wearing strong perfumes/colognes.
• Please keep gym bag out of walkways.
• While busy, please refrain from using cardiovascular equipment in excess of 40 minutes.
• Members 13-17 years of age must be accompanied by a parent or guardian before 8:00 a.m. and after 6:00 p.m.
CATEGORY OF MEMBERSHIP
1. Single Membership.
A single membership is defined as Individual Member from 13 years of age (with parental consent) or older.
2. Double Membership.
A double membership is defined as Member 18 years of age or older and one more person who resides as a permanent member of the Member’s household who is his/her: a) spouse or domestic partner, b) child or ward 13-20 years of age.
3. Family Membership.
A family membership is defined as Member 18 years of age or older, their spouse or domestic partner, and their children or wards under 21 years of age who reside as permanent residences of the Member’s household. A family membership may also be defined as a Member 18 years of age or older and two or more children or wards under 21 years of age who reside as permanent residents of the Member’s household. Family memberships may be subject to address verification.
CHALK
Use of powdered chalk is not permitted. Liquid chalk is available for purchase and is permitted for use in the club.
CHANGE OF ADDRESS, EMAIL & PHONE NUMBER
Members must notify the Club in writing (at 1140 N Lemoore Ave, Lemoore CA) or via email
(bodyshophealthclub@gmail.com) of any change of address, email and/or phone number. Members who fail to do so shall be deemed to have waived any notice provided for under these Rules, and all communications will be presumed to have been received by the fifth day after mailing and/or phone contact.
CHILDREN (Under 13 years of age)
Children under 13 years of age are not allowed in any fitness areas (e.g., cardio room, weight rooms, functional fitness areas, floor seating areas) and must be under constant adult supervision in all other areas of the facility. Children under 13 years of age are not permitted in the Group Exercise studios unless they are participating in a Club sponsored activity specifically for children.
CHILDREN (13 to 17 years of age)
Children 13 to 17 years of age may use Club facilities from 8:00 a.m. until 6:00 p.m. without adult supervision providing they follow all the rules and regulations of the Club. After 6:00 p.m., parent or legal guardian supervision is required. Use of weights and cardiovascular equipment is permitted only after parental written consent is received by TBSHC. Approval is needed from the Group Exercise instructor to participate in a Group Exercise class.

Comments regarding other members should be directed to the TBSHC Staff.
CONDUCT
TBSHC Management reserves the right to suspend or terminate the privileges of members who do not conform to TBSHC Rules. TBSHC adopts a zero-tolerance policy regarding inappropriate conduct. Such conduct may include (but is not limited to) loud, boisterous, or obscene language and/or gestures, offensive language, profanity, abusive language, lewd conduct, harassment, attempts to reprimand Club employees,
or conduct that would be deemed bothersome by TBSHC management, as well as any conduct that may endanger the best interest of the Club, its employees, members, or guests. Members are also responsible for the conduct of their children.
DAMAGES
Any damage to TBSHC’s property by any member or his/her children shall be paid for by the member.
DRESS CODE
Shirts must be always worn throughout the facility. Shirts cover the back and front of the chest; Gym crops are, however, acceptable. shorts/pants must cover the entire bottom; close-toed shoes are always required. Bare feet are permitted in the restrooms/locker rooms and exercise studios only. Stocking feet, sandals, hard-soled dress shoes, boots and jeans are not permitted.
DUES
The obligation to pay dues is not dependent on the availability of all the Club’s facilities or the member’s frequency of use. Repairs, maintenance and/or other occurrences may make it necessary for the Club to restrict the use of one or more facilities or to close the Club temporarily. The Club will not reduce or suspend dues during the time when facilities are not available.
Members must provide an email address to receive club updates and other information, regarding their account status, correspondence, etc.
FACILITY ENHANCEMENT FEES
Members will be charged a nominal facility fee each calendar quarter. The fee will be used for equipment maintenance and upgrades, facility improvements and any other club enhancement that may be needed.
FREE WEIGHT ROOMS
• Proper workout attire required (no jeans, open toe shoes or thongs).
• Wipe down equipment after use.
• Personal items should not be used to reserve or occupy multiple benches and/or space.
• Report any maintenance issues to the front desk.
. • No food or drink, except bottled water and energy drinks. No glass containers.
• Keep gym bags out of walkways.
• Use of portable music devices where sound is auditable outside of headphones (e.g., Bluetooth speakers) are prohibited.
• Return all weights to racks after use.
• Never lean weights against walls or mirrors.
• Do not drop weights
• Always use collars.
FRONT COUNTER/JUICE BAR
The Front Counter is designed to accommodate the needs of all members. Services provided include
member check-in, personal training reservations and check-in, purchase of retail items and food/beverages, changes to membership, first aid and replacement membership key tags. Make all payments at the front counter.
24-HOUR ACCESS PRIVILEGE
24-Hour Access Privilege
As a member of The Body Shop Health Club, you are provided with 24-hour access to our facility and services authorized and limited pursuant to your membership agreement. Members who have paid their membership dues on time and in full will continue to have access to our facility 24/7.
During normal business hours, all members are required to check in inside of our lobby. After-hours access is limited to authorized members of the club. Each member must use their own barcode or key tag to access the facility. Any unauthorized person who is permitted entry on a member’s key tag, will be subject to a $100 fine.
Unauthorized access includes providing access to any unauthorized person on both entry and exit of the facility. This fine will be charged to my nominated credit card/ debit card/ bank account held on file. Future misuse may result in membership suspension or termination.
GROUP EXERCISE STUDIO RULES
• Stop exercising if you experience dizziness, pain, or unusual discomfort.
• Accelerated weight loss clothing is not permitted.
• Children under 13 years of age are not permitted unless they are participating in a club-sponsored activity specifically for children.
• Proper workout attire required (no jeans, open toe shoes or thongs).
• No food or drinks, except bottled water and performance beverages. No glass containers.
• No portable music devices (e.g., MP3, iPod) during class. Please listen to the instructor.
GUARDIAN
• Legal Guardian - A legal guardian may be required to provide TBSHC with documentation showing status of guardianship.
HOLD STATUS CHARGE
A member in good standing may place membership on hold for a maximum of two (2) months by providing written request. If member’s membership remains on hold after the 2-month period, membership will be reactivated unless prior arrangements have been made with TBSHC. The facility enhancement fee will be collected during a hold.

LOCKER ROOMS
• TBSHC is not responsible for lost, damaged or stolen articles.
• No camera cell phones allowed.
• Secure lockers with a padlock and remove them after use.
• Contents left overnight may be removed. Do not store valuables in lockers. Lockers are solely for temporary clothing storage.
• Children under 13 years of age are permitted only when accompanied by a parent or legal guardian.
LOST & FOUND
TBSHC maintains a Lost & Found area. TBSHC does not assume responsibility for items turned into the Lost & Found. Members must identify and claim articles in person. Items unclaimed after 2 months will be discarded.

MEMBERSHIP KEY TAG
Each member must show their own membership key tag access card and have a picture taken to enter the facility. Members shall not permit use of their card by anyone else, or assist any third person, non-member to use the TBSHC without authorization by club as a guest user. Violation of the foregoing may subject member and/or account holder to a fee and/or cancellation of membership. If a member’s membership key tag access card is lost or stolen, the member must request a new membership key tag. There is a fee to replace lost or stolen membership key tags.
Membership key tags that are worn will be replaced at no charge.
Returning Members who are Active Duty Military and have retained their key tag will not need to re-purchase a key tag on their return to the Club.
OBSTRUCTING EMPLOYEES
It shall be grounds for disciplinary action, including termination of membership, for members or guests to abuse any of the TBSHC staff, verbally or otherwise. Members shall not instruct any of the TBSHC staff, nor shall members request any of the staff to leave the TBSHC for any purpose whatsoever.
Members are requested to report misbehavior or violations of Rules or laws committed by employees, and other members or guests, to TBSHC Management. Violations will be subject to disciplinary action as deemed necessary by TBSHC. Members are not permitted to request special personal services from employees.
PARKING
Members are encouraged not to leave visible items in their automobiles. TBSHC is not responsible or liable for articles damaged, lost, or stolen in or about the TBSHC, or for loss and/or damage to any property including, but not limited to, automobiles and/or the
contents thereof.
PAYMENT OF DUES AND DELINQUENCY CHARGES
TBSHC utilizes a direct debit system against members’ major credit cards/debit cards and/or bank account for monthly billing memberships and fees. Members must provide the Club with a current major credit card/ debit card or bank account information for direct debit of dues. Members must inform TBSHC of any changes in their direct debit account that might affect prompt payment. Failure to pay TBSHC on time will result in temporary suspension of membership privileges and may further result in termination of membership. The card holder is financially responsible for all other members on the membership, including returned checks or declined credit card charges. All balances will be drafted each month through EFT.
If a credit card or direct debit from a checking/savings account is declined, the member will be notified. To offset the costs of follow-up, fee’s generated by the third-party billing service and to encourage repeat offenders to comply with payment terms, a $10.00 late fee will be added to any delinquent amount not received by TBSHC. If a member’s account goes unpaid, Club privileges will be suspended, the membership will be subject to termination and unpaid balances will be turned over to collection agency.
If an account is delinquent, the Club may take whatever action it deems necessary to effect collection. If the Club commences any legal action to collect any initiation fees, membership dues or other indebtedness owed by any member of the Club or to enforce any liability of such member to the Club, and if judgment is obtained by TBSHC, such member shall also be liable for all costs and expenses of such legal action, including reasonable attorneys’ fees.
PERSONAL PROPERTY
Personal property (e.g., gym bags, purses, extra clothing) is not permitted in workout areas. Personal property of members or guests, while in or on TBSHC premises or while deposited with the Club shall be at the owner’s sole risk. TBSHC will not be responsible for any loss of personal property left on the premises, including items left in lockers or with an employee of TBSHC.
PREPAID MEMBERSHIPS
Excluding relocation, disability, and death, all prepaid memberships (yearly or otherwise) are not refundable for any reason.
PROHIBITED ITEMS
Weapons and illegal drugs are not permitted on Club property. Alcoholic beverages are not permitted, except at authorized TBSHC -sponsored social events. Use and solicitation of anabolic steroids and illegal drugs is strictly prohibited. Persons found in possession of or under the influence of will be subject to membership termination. Persons under the influence of drugs and/or alcohol are not permitted to use the facility.
PUBLIC RELATIONS
The Club reserves the right to photograph and/or videotape at any time in members’ presence without
their knowledge or consent.
RESISTANCE TRAINING AREAS
• Proper workout attire required (no jeans, open toe shoes, string tank tops or thongs).
• Wipe down equipment after use.
• Personal items should not be used to reserve or occupy multiple machines and/or space.
• Report any maintenance issues to the front desk.
• No food or drink, except bottled water and energy drinks. No glass containers.
• Use of portable music devices where sound is auditable outside of headphones (e.g., Bluetooth speakers) are prohibited.
• Keep gym bags out of walkways.
SAUNA
Persons must be 18 years or older to use the sauna.
SMOKING
Smoking is not permitted anywhere on
TBSHC property.
SOLICITATION
Members cannot post or circulate commercial advertisements in or around the Club, nor can they solicit funds.
TANNING
Persons must be 18 years or older. Protective eyewear is required. 24 hours is required between tanning sessions. All persons must sign a Tanning Release of Liability.
